Terms and Conditions
1. General Information
These Terms and Conditions establish the general rules governing the use of the BIRD GREEN EXPEDITIONS website and the booking, purchase, and provision of tourism services offered through our communication channels.
Throughout this document, “BIRD GREEN EXPEDITIONS,” “the Company,” “we,” “our,” and “us” refer to the travel agency operating under this commercial name. “Traveler,” “client,” “you,” and “your” refer to any person who requests information, makes a booking, purchases a service, or participates in an activity arranged by the Company.
By requesting or confirming a booking, making a payment, or participating in one of our tours, you acknowledge that you have been provided with the applicable service information and agree to these Terms and Conditions, together with the relevant Booking Policy, Advance Payment Policy, Cancellation and Refund Policy, and Personal Data Protection Policy.
These documents must be read together. If a specific service confirmation establishes additional conditions, those conditions will apply to that service provided that they do not conflict with mandatory applicable law.
2. Services Offered
BIRD GREEN EXPEDITIONS offers tourism experiences in Peru, which may include guided tours, cultural visits, nature excursions, trekking activities, transportation arrangements, entrance tickets, and other travel-related services.
The exact services available depend on the destination, selected itinerary, travel date, operational conditions, and availability of third-party providers.
Before making a booking, travelers should carefully review the itinerary, duration, meeting point, inclusions, exclusions, physical requirements, and any special conditions communicated for the selected service.
Unless expressly stated in the written confirmation, a service does not automatically include accommodation, meals, entrance tickets, transportation, personal equipment, travel insurance, tips, or expenses not specifically listed as included.
3. Information, Prices, and Service Availability
The Company seeks to provide accurate and up-to-date information regarding itineraries, schedules, prices, and service conditions. However, some details may depend on the availability and operating rules of transportation companies, accommodation providers, local authorities, attractions, and other independent suppliers.
Prices will be communicated before the booking is confirmed. The applicable price, currency, payment schedule, included services, and any relevant additional charges must be stated or confirmed through the agreed communication channel.
A quotation does not constitute a confirmed booking unless the required booking steps have been completed and the Company has issued confirmation.
Any applicable taxes, mandatory fees, or additional charges will be communicated as required by law and the conditions of the selected service.
4. Reservations and Booking Confirmation
A booking request may require the travel date, number of participants, full names, nationality, passport or identity document information, contact details, and other information necessary to arrange the service.
A reservation is considered confirmed only when BIRD GREEN EXPEDITIONS has communicated its confirmation and the applicable booking requirements have been satisfied. Where a deposit or advance payment is required, the booking confirmation will specify the relevant amount and conditions.
Certain services, including Machu Picchu visits, train journeys, restricted attractions, and activities requiring permits or limited-capacity tickets, may depend on availability and specific identification details. A request or quotation alone does not guarantee that tickets or permits have been secured.
The traveler is responsible for reviewing the confirmation and promptly reporting any errors in names, dates, passenger details, or requested services.
Further details are established in our Booking Policy.
5. Payment Conditions
Payments must be made through the methods and within the deadlines communicated by the Company. Travelers should retain receipts, transfer confirmations, and written booking communications until the service has been completed.
An advance payment may be required to secure reservations, purchase tickets, or confirm services with third-party suppliers. The payment amount, outstanding balance, due date, and any service-specific conditions will be communicated before payment.
A booking may remain unconfirmed while a required payment is pending. If an outstanding balance is not paid by the agreed deadline, the Company will contact the traveler and explain the available options and any consequences that may apply under the confirmed booking conditions and applicable law.
Payment, cancellation, and refund arrangements are detailed in the Advance Payment Policy and Cancellation and Refund Policy.
6. Changes to Itineraries and Schedules
Tour itineraries and schedules may be affected by weather, road conditions, strikes, transport disruptions, local regulations, safety concerns, closures, or other circumstances beyond the Company’s reasonable control.
When a change is necessary, the Company will communicate relevant information as soon as reasonably possible and explain available alternatives. Any material change to the service will be handled in accordance with the applicable booking terms and mandatory consumer-protection rules.
Travelers should arrive at the designated meeting point at the confirmed time and follow the instructions provided by the guide or operational team.
7. Health, Fitness, and Safety
Some tours involve walking, uneven terrain, steep paths, cold temperatures, remote locations, or high-altitude conditions. Travelers are responsible for reviewing the physical requirements of their selected activity and informing the Company in advance of relevant limitations or assistance needs.
Travelers should follow the guide’s safety instructions, remain within designated areas, and avoid conduct that puts themselves or others at risk.
The Company may recommend that a traveler not participate in a particular activity if there are reasonable safety concerns. Any resulting change or alternative will be handled according to the circumstances, the confirmed service conditions, and applicable law.
Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.
8. Traveler Responsibilities
Travelers must provide accurate booking information, carry valid identification and any required travel documents, arrive on time, respect local communities and cultural sites, and comply with applicable laws and safety instructions.
Travelers are responsible for obtaining any visas, permits, health-related documentation, or other personal documents required for their trip, unless the Company has expressly agreed in writing to arrange a specific item.
Any additional expense caused by incorrect information, missing documents, late arrival, or failure to follow communicated requirements will be assessed according to the circumstances and applicable law.
9. Third-Party Providers
Certain elements of a trip may be delivered by independent transportation companies, hotels, restaurants, guides, ticketing systems, or other service providers.
Where a third-party provider is involved, its operational requirements and service conditions may apply. The Company will communicate material conditions known to it and will address concerns relating to the services it arranged within the scope of its responsibilities.
This section does not remove any rights or remedies available to travelers under applicable law.
10. Cancellations, Refunds, and Complaints
Cancellation requests must be submitted in writing through the communication channel used for the booking or another official channel designated by the Company.
Refund eligibility, processing, date changes, cancellations by the Company, and circumstances involving non-refundable third-party costs are governed by the Cancellation and Refund Policy and the conditions disclosed before confirmation.
Travelers may contact the Company to raise questions or concerns about a service. Complaints will be reviewed in good faith and handled in accordance with applicable consumer-protection requirements, including the right to use any legally available complaint mechanism.
11. Personal Data and Website Use
Personal information provided during inquiries and bookings will be handled in accordance with the Personal Data Protection Policy and applicable Peruvian data protection law.
Website content, including text, photographs, logos, graphics, and other materials, may not be reproduced or used commercially without authorization, except where permitted by law.
Users must not use the website for unlawful activities, submit fraudulent booking information, interfere with website operation, or attempt unauthorized access to systems or data.
12. Applicable Law and Updates
These Terms and Conditions are governed by the applicable laws of Peru, including mandatory consumer-protection and personal-data protection provisions.
Any dispute will be addressed through the applicable procedures and competent authorities established by law. Nothing in this document prevents a traveler from exercising statutory rights.
BIRD GREEN EXPEDITIONS may update these Terms and Conditions when necessary to reflect operational, legal, or service changes. The version applicable to a confirmed booking will be assessed in light of the terms communicated at the time of purchase and any mandatory legal requirements.
